Boundary disputes occur when there is uncertainty about where a boundary lies and who actually owns what land. They can cause significant stress and friction between neighbours - not for nothing do we say ‘Good boundaries make good neighbours’.
Boundary and land disputes seem to have become more common in recent times, probably due to the increase in property prices and land values.
Owing to the very complex nature of land records, and the lack of precise boundaries on most title deeds, a chartered surveyor is often required to help solve disputes.

How are property boundaries governed?
In England and Wales, we use a general boundary system with HM Land Registry using Ordnance Survey (OS) maps to draw up a ‘title plan’ for each property, showing the ‘general boundary.’
Title plans don’t show exact boundaries (unless officially determined and recorded), nor do they define the ‘legal’ boundary, but they usually provide enough detail to establish a general agreed boundary between homes. However, these boundaries can change over time, for example when land is sold, or if neighbours come to a verbal agreement that is not recorded in title deeds.
